This Indemnity, Liability Waiver and POPIA Consent Agreement (“Agreement”) is entered into by the undersigned participant and/or parent/guardian and/or authorised representative signing on behalf of all participants listed in this registration.

 

1. SCOPE OF EVENT AND ACTIVITIES

This Agreement applies to all participants, spectators, volunteers, and visitors attending or participating in any part of the event and covers all activities, venues, and related areas, including but not limited to:

• The Triple Challenge multi-discipline event
• The 5km Fun Run / Fun Walk
• The 10km Duathlon (Run/Cycle/Run or Cycle/Run/Cycle variations)
• The 17.5km Duathlon (Run/Cycle/Run or Cycle/Run/Cycle variations)
• All Kidz Zone activities and entertainment areas
• Any school-hosted or school-affiliated sporting or recreational activities
• All parking areas, spectator zones, registration areas, and warm-up zones
• All access routes, roads, trails, and pathways used for the event
• Any associated areas on or off-site used in connection with the event

This includes, without limitation, all areas within Southcity Christian Schools premises, as well as external locations connected to the event, including Doveton Farm and Elliott Farm, used for the Fun Run/Walk and Duathlon events.

 

2. ENTRY ONTO PREMISES

 By entering the event venue or any associated property, all participants, spectators, and visitors acknowledge that they do so entirely at their own risk.

The organisers, including Southcity Christian Schools, its staff, volunteers, contractors, sponsors, landowners, and event partners, accept no responsibility for any loss, damage, injury, illness, or death that may occur on or after entry onto the premises.

 

3. ASSUMPTION OF RISK

 Participation and attendance at the event is entirely voluntary. The undersigned acknowledges and accepts that participation in all activities involves inherent risks, including but not limited to:

• Physical injury, illness, fatigue, dehydration, or medical emergencies
• Accidents related to running, cycling, sport participation, or physical exertion
• Falls, collisions, or contact with other participants, objects, or terrain
• Weather conditions, uneven surfaces, natural terrain, and environmental hazards
• Risks associated with Kidz Zone play equipment and supervised activities
• Risks associated with farms, open land, trails, roads, and outdoor environments

The participant voluntarily assumes all risks, whether foreseeable or unforeseeable.

 

4. INDEMNITY AND LIABILITY WAIVER

By signing this Agreement, the participant (and/or parent/guardian and/or authorised representative) hereby:

• Fully waives all claims against Southcity Christian Schools, its governing body, staff, employees, volunteers, contractors, sponsors, landowners, and event partners
• Releases and holds harmless all organisers and associated parties from any liability for injury, illness, loss, damage, theft, or death arising from participation or attendance
• Accepts full responsibility for their own safety and that of any minors or participants they are registering
• Indemnifies all organisers and associated entities against any claims, damages, costs, or expenses arising from participation in the event

This waiver applies to all activities listed in Section 1, including the Triple Challenge, Fun Run/Walk, Duathlons, Kidz Zone, and all associated event areas.

This indemnity explicitly includes Doveton Farm and Elliott Farm, their owners, employees, agents, and representatives, for any incidents occurring on or related to their property or land used for event purposes.

 

5. MEDICAL CONSENT

In the event of injury or medical emergency, the organisers are authorised to obtain or provide emergency medical treatment as deemed necessary.

All costs associated with medical treatment, evacuation, or emergency response remain the sole responsibility of the participant or their parent/guardian.

 

6. ONE SIGNATORY AUTHORITY

Where this registration includes multiple participants, the person completing and submitting the form confirms that they:

• Are fully authorised to register all listed participants
• Are authorised to accept this Agreement on behalf of all participants
• Bind all participants to the terms and conditions contained herein

 

7. PROTECTION OF PERSONAL INFORMATION (POPIA CONSENT)

In accordance with the Protection of Personal Information Act (POPIA), the undersigned consents to the collection, storage, processing, and use of personal information for purposes including:

• Event registration and administration
• Communication regarding the event
• Safety and emergency management
• Record keeping and reporting

Personal information may include names, contact details, age categories, and participation details.

 

8. MEDIA, PHOTOGRAPHY AND MARKETING CONSENT

The undersigned consents to the use of photographs, video recordings, and/or audio recordings of participants taken during the event for purposes including but not limited to:

• Southcity Christian Schools marketing and promotional material
• Social media platforms
• School publications and newsletters
• Advertising and promotion of future events
• Internal and external communications

This includes media captured at all venues, including school grounds, farms, Kidz Zone areas, and event routes.

 

9. ACKNOWLEDGEMENT AND ACCEPTANCE

By submitting this registration and ticking the acceptance box, the undersigned confirms that they have fully read, understood, and voluntarily agree to all terms contained in this Agreement.

 

10. DECLARATION

By accepting this Agreement, I confirm that:

• I am legally authorised to act on behalf of all participants listed
• I accept full responsibility for all participants under this registration
• I understand and accept all risks associated with participation and attendance
• I waive and release all liability as set out in this Agreement
